Under GINA, employers may not require genetic testing, or use information about genetics (including family medical history) as a factor in hiring, promoting, demoting, or firing employees. This includes if an employee is a caretaker for someone with a genetic disorder. Health insurers cannot use genetic information when making coverage and premium decisions. Finally, an employer wellness program cannot require participants to answer questions about their family medical history.
